Former Aviation Minister Femi Fani-Kayode has been discharged and acquitted of all 12 charges related to the procurement of a “fabricated” medical report and its use, by the Lagos State Special Offences Court in Ikeja on February 4.

In her ruling, Justice Olubunmi Abike-Fadipe determined that the Economic and Financial Crimes Commission (EFCC) did not have the constitutional authority to prosecute Fani-Kayode on the matter. The judge emphasized that the allegations did not constitute an economic crime and that the evidence and witnesses presented failed to link the former minister to the offences.

The EFCC had accused Fani-Kayode of collaborating with Dr. Ogieva Oziegbe to produce a fake medical report, which he allegedly submitted in the ongoing money laundering case at the Federal High Court before Justice Daniel Osiagor.

The EFCC claimed that, on October 11, 2021, in Kubwa, Abuja, Fani-Kayode and Dr. Oziegbe fabricated a medical document titled ‘MEDICAL REPORT ON Olufemi Fani-Kayode 60 YEARS/MALE/HOSP. NO.00345’, falsely attributing it to Kubwa General Hospital.

The Commission argued that this act violated Section 369 of the Criminal Law of Lagos State (2015), which addresses forgery and false pretence. However, Fani-Kayode pleaded not guilty to the charges.
