The High Court in Delta State has turned down Davido‘s plea for a stay of proceedings in the breach of contract case filed against the music star for his absence at the Warri Again event.

Brownhill Investment Company Limited, organizers of the annual Warri Again event, is pursuing a 2 billion naira claim for general damages, alleging Davido breached the contract by failing to perform at the Warri Again event in 2023.

In addition to general damages, the claimant is seeking N150 million for legal and professional fees and an extra N30 million as the cost of filing the suit.

Davido‘s lawyer, Mr. Norrison Quakers, SAN, requested a stay of proceedings, asking the court to pause the lawsuit since the case was before the Court of Appeal, a superior court of record.

The application was dismissed, with the court ruling that proceedings would continue in the High Court until an order for a stay is obtained from the Court of Appeal.

The court also approved the motion to regularize the claimant’s reply to the statement of defence and directed the filing of Pre-Trial Conference, PTC, forms within 14 days as per court rules.

The case has been adjourned for a pre-trial conference on March 21, 2024.
